STAFF REVIEW AND COMMENT: Project engineer WHKS & Co. has reviewed the public
improvements for the 11th and 17th Street Culverts Project and find it in substantial conformance with
the project plans and specifications.
RECOMMENDATION: Approve the resolution.

RESOLUTION 2026-
RESOLUTION ACCEPTING THE 11TH AND 17TH STREET
CULVERTS
WHEREAS, on the 21st day of October, 2024, the Mayor and Clerk of the City of Waukee,
Iowa, entered into a construction contract with Nagel Construction, LLC, of Allerton, IA, for the
construction of certain public improvements generally described as the 11th and 17th Street
Culverts; and
WHEREAS, the contractor has fully completed the construction of the public
improvements in accordance with the terms and conditions of the contract and plans and
specifications, as shown by the certificate of the Engineer filed with the Clerk on May 15, 2026:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WAUKEE, STATE OF IOWA:
Section 1.That the report of the Engineer be and the same is hereby approved and adopted,
and the public improvements are hereby approved and accepted as having been fully completed in
accordance with the plans, specifications and form of contract and the total final construction cost
thereof is hereby determined to be $568,089.00, as shown in the report of the Engineer.

PROJECT ACCEPTANCE CERTIFICATION
RE: City of Waukee
11th and 17th Street Culverts
WHKS & Co. hereby certifies that we have coordinated with the Contractor and City staff performing
field observation of the construction work completed on the above referenced project by Nagel
Construction, LLC.
A final project walkthrough was held on May 14, 2026 to develop a punch list. We find the project to be
in substantial compliance with the Plans, Specifications, and Change Orders governing the project
within the contract period upon successful completion of the punch list. The final amount of the Contract
is Five Hundred Sixty-Eight Thousand Eighty-Nine and 00/100 Dollars ($568,089.00).
