RESOLUTION 2020-008
APPROVING A MEMORANDUM OF UNDERSTANDING WITH COMMUNICATIONS
WORKERS OF AMERICA (CWA), LOCAL 47102, AFL-CIO, AS PART OF THE DULY 1,
2016 — JUNE 30, 2021 CONTRACT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on May 23, 2016, the Waukee City Council approved a Collective Bargaining
Agreement with the Communications Workers of America (CWA), Local #7102, AFL-CIO, in effect
July 1, 2016 through June 30, 2021 (Resolution #16-219); AND,
WHEREAS, the City of Waukee and representatives of CWA, Local #7102, have reviewed and
approve a Memorandum of Understanding which modifies the allowable use of sick leave for full-time
employees; AND;
WHEREAS, the Memorandum of Understanding is attached hereto and by reference incorporated
herein;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 6'' day
of January 6, 2020, that the Memorandum of Understanding with Communications Workers of
America (CWA), Local 47102, AFL-CIO, as part of the July 1, 2016 — June 30, 2021 contract, is

MEMORANDUM OF UNDERSTANDING BETWEEN
THE CITY OF WAUKEE, IOWA AND
'POE COMMUNICATIONS WORKERS OF AMERICA, LOCAL 7102, AFL-CIO
This Memorandum of Understanding ("Mtmo") is entered into on this 16" day of December 2019, by and
between the City of Waukee, Iowa ("City') and the Communications Workers of America, Local 7102, AFL-CIO
("Union").
WHEREAS, City and Union entered into a collective bargaining agreement for the period of July 1, 2916,
through June 30, 2021," (tbe "Contract"); and
WHEREAS, the Contract governs certain conditions of employment for members of the Union who are
employed by City; and
W H EREAS, this Memo adds a new component to the use of sick leave; and
IT IS THEREFORE AGREED, by and between City and Union as follows:
A. An additional sentence to the end of Article 11, Section IC, shall be revised to state (change in bold),
Siek leave may be used by an Employee when the Employee is medically unable to perform the
duties of their job due to illness or injury, or when the employee is required to care for an ill or
injured family member. Sick leave may also be used when approvod in advance, for dental
surgical medical or optical examinations or treatment or in an emergency. The employer may
require a physician's written statement to verify sick leave usage. Sick leave may also be used
In accordance with the Trade Time for Fitness program as long as the program is in effect.
E. This interpretation shall be effective January 1, 2020. The parties agree that this Memo has no
precedential value and shall not be used as evidence of pest practice in the future
