HomeMy WebLinkAbout2020-07-06-Resolution 2020-245_Residential Purchase Agreement Addendum, 1230 S Warrior LnTHE CITY OF WAUKEE, IOWA RESOLUTION 2020-245 RESOLUTION APPROVING ADDENDUM TO RESIDENTIAL PURCHASE AGREEMENT FOR CERTAIN PROPERTY LOCATED IN THE CITY OF WAUKEE IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND WHEREAS, the City entered into a Residential Purchase with Kurt Schade and Jana Schade (collectively the "Sellers"), for certain property locally known as 1230 S Warrior Lane, Waukee, Iowa which is scheduled to close on July 2, 2020; AND WHEREAS, the Sellers are desirous of leasing back the property for a period of ten days following the closing on the property; AND WHEREAS, the proposed Addendum to Residential Purchase Agreement is attached as Exhibit "A." NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee that the Addendum to Residential Purchase Agreement attached hereto as Exhibit A is approved. Lyon X Ben Sinclair X ADDENDUM TO REAL ESTATE PURCHASE AGREEMENT THIS Addendum to real estate contract dated Mav (BUYER) and Kurtis Schade and Jana Schade+ following addendum: G. Other 15, 2020 , by and between the City of Waukee (SELLER) is hereby amended to include the Add paragraph 3) SELLER shall have the non-exclusive right to continue to occupy the Residence for 10 days following closing to allow SELLER additional time to move from said Residence. SELLER agrees that BUYER shall not have any responsibility for any damage, loss, or theft associated with the personal property left by SELLER, or SELLERS use or occupancy of the residence or Property during that period. Any of SELLER's personal property remaining within the Residence following the 10 day period, or notification from SELLER that they have vacated the residence, whichever shall first occur, may be disposed of by BUYER in any manner it sees fit. SELLER shall maintain casualty and liability insurance covering the Property, residence and its contents during the period that they continue to occupy the residence and pay unto BUYER the sum of S850.00 for the 10 day period that SELLER's remains in the Residence, as rent. SELLER shall be responsible for any and all damages that occur while they continue to occupy said residence and the associated Property.
