RESOLUTION 2020-227
APPROVING A MEMORANDUM OF UNDERSTANDING WITH COMMUNICATIONS
WORKERS OF AMERICA (CWA), LOCAL #7102, AFL-CIO, AS PART OF THE JULY 1,
2016 — JUNE 30, 2021 CONTRACT
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on May 23, 2016, the Waukee City Council approved a Collective Bargaining
Agreement with the Communications Workers of America (CWA), Local #7102, AFL-CIO, in effect
July 1, 2016 through June 30, 2021 (Resolution #16-219); AND,
WHEREAS, the City of Waukee and representatives of CWA, Local #7102, have reviewed and
approve a Memorandum of Understanding which modifies the pay rates for a Parks Department
employee and places them in a newly created open position; AND;
WHEREAS, the Memorandum of Understanding is attached hereto and by reference incorporated
herein;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 15`,
day of June 2020, that the Memorandum of Understanding with Communications Workers of America
(CWA), Local #7102, AFL-CIO, as part of the July 1, 2016 — June 30, 2021 contract, is hereby
approved.

MEMORANDUM OF UNDERSTANDING BETWEEN
THE CITY OF WAUKEE, IOWA AND
THE COMMUNICATIONS WORKERS OF AMERICA, LOCAL 7102, AFL-CIO
This Memorandum of Understanding ("Memo") is entered into on this 1811 day of May 2020, by and between
the City of Waukee, Iowa ("City") and the Communications Worker; of America, Local 7102, AFL-CIO ("Union").
WHEREAS, City and Union entered into a collective bargaining agreement for the period of July 1, 2016,
through June 30, 2021," (the "Contract"); and
WHEREAS, the Contract governs certain conditions of employment for members of the Union who are
employed by City; and
WHEREAS, this Memo identifies an agreement between the parties to allow a certain employee to accept a
vacant position while maintaining their current wage rate through the end of the current contract; and
IT IS THEREFORE AGREED, by and between City and Union as follows:
A. The City plans to eliminate the following position effective June 30, 2020:
I. Parks Superintendent— currently occupied by Ron Heiman.
B. Effective July 1, 2020, the City will look to hire an additional person for the followingjob:
1. Parks Laborer.
C. The parties have agreed that —instead of posting the vacant position --since the above -referenced
employee is already performing the duties of the vacant position, they will be placed into the vacant
position and onto the appropriate wage scale for the vacant position; however, the City agrees to keep
the above -referenced employee's wage the same as of June 30, 2020, through the end of the current
contract —which would result in the following hourly wage from June 30, 2020, through June 30, 2021:
1. Ron Heiman - $37.27 per hour.
D. Additionally, the employee's wage would be gradually aligned, over a penod of three years, to ultimately
land at step I 1 of the Parks Laborer wage matrix in place on July 1, 2023.
E. The undersigned acknowledge and represent that they are authorized to enter into this Agreement and
that the terms and conditions are binding upon the parties, their officers, members, successors and
assigns.
E. This interpretation shall be effective upon the execution of this Memo.
