BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code, Zoning Ordinance of the City,adopting the Official Zoning Map,is hereby amended by changing the following described real estate from M-I (Light Industrial District)to C-1 (Community and Highway Service Commercial District),and that the Official Zoning Map be made to reflect such amendment: Parcel B of the Plat of Survey of the Southeast Y.of Section 27,Township 79 North,Range 26 West of the 5th P.M.,City of Waukee,Dallas County,Iowa recorded in Book 2002 at Page 19734 of the Dallas County,Iowa Records.(Does not include 5.913 acres for the MidAmerican Energy substation) Also known as the Knapp Property AND A parcel ofland located in Section 27,Township 79 North,Range 26 West of the Fifth Principal Meridian,City of Waukee,Dallas County,Iowa,being described as follows: Beginning at the center of said Section 27,thence South 00°30'12"west, 740.02 feet,along the east line of the Southwest Y.of said Section 27;thence North 89°59'38"west,1023.65 feet;thence North 00°00'00"west,739.99 feet,to a point on the north line of the Southwest Y.of said Section 27;thence South 89°59'38"east,1030.15 feet,along the north line of the Southwest Y.of said Section 27,to the point of beginning (containing 17.44 acres more or less) Also known as the Grubb Property Section 2.Repealer,All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
