AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND
CHANGING CERTAIN PROPERTY THEREIN FROM M-1 (LIGHT INDUSTRIAL
DISTRICT)TO C-4 (OFFICE PARK COMMERCIAL DISTRICT)AND AMEND THE
OFFICIAL ZONING MAP:rO SHOW RE-ZONING.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning
Ordinance of the City,adopting the Official Zoning Map,is hereby amended by
changing the following described real estate from M-1 (Light Industrial
District)to C-4 (Office Park Commercial District),and that the Official Zoning
Map be made to reflect such amendment:
A PARCEL OF LAND LOCATED IN THE SOUTH HALF OF SECTION
35,TOWNSHIP 79 NORTH,RANGE 26 WEST OF THE 5TH P.M.,IN
THE CITY OF WAUKEE,DALLAS COUNTY,IOWA THAT IS MORE
P ARTICULARL Y DESCRIBED AS FOLLOWS:BEGINNING AT THE
N.W.CORENER OF THE SOUTHWEST Y.OF SAID SECTION 35;
THENCE N89°52'37"E,1379.50 FEET TO A POINT;THENCE
SOooOO'OO"W,541.81 FEET TO A POINT OF CURBATURE WITH A
RADIUS 735.00 FEET AND AN ARC LENGTH OF 415.85 FEET TO A
POINT OF TANGENCY S32°26'00"W,55.42 FEET TO A POINT;
THENCE S32°25'00"W,491.89 FEET TO A POINT OF CURVATURE
WITH A RADIUS OF 1373.19 FEET AND AN ARC LENGTH OF 487.82
FEET TO A POINT OF TANGENCY S89°59'45"W,827.39 FEET TO A
POINT;THENCE NOoo04'00"W,1452.01 FEET TO A POINT;THENCE
NOoo04'00"W,406.69 FEET TO THE POINT OF BEGINNING AND
CONTAINING A TOTAL OF 50.50 ACRES,MORE OR LESS.
Also known as a portion of Williams Pointe.
Section 2.Repealer,All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect
the validity of the ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final
passage,approval and publication as provided by law.

approved this 1ih day of March 2003.
