AN ORDINANCE TO AMEND CHAPTER 111,SECTION 111.3,WAUKEE
MUNICIPAL CODE,RECORDS RETENTION,TO PROVIDE FOR A CHANGE IN
PROCEDURE WHEN DESTROYING RECORDS BY DELETING "SECTION 111.3"
AND BY INSERTING IN LIEU THEREOF,A NEW "SECTION 111.3"
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Chapter 111,Section 111.3,Records Retention,is amended by deleting
Section 111.3 and inserting in lieu thereof Section 111.3 so that said Section reads as
follows:
Section 111.3 Records Retention The Clerk
shall,upon order of the council,destroy all records and papers other than the minutes of
the council proceedings,ordinances,resolutions and instruments having to do with real
estate or bond issues,when such records may be destroyed as reconnnended in the Iowa
Retention Manual or in accordance with state law.The clerk shall prepare a list of
material to be destroyed and present such list to each department so that each department
may agree or disagree with the destruction of the documents.Once an agreement as to
which documents are to be destroyed has been reached,the clerk or hislher designee shall
prepare a resolution for council action each year listing the records to be destroyed.
Section 2.Repealer.A 11 ordinances or p arts 0 f ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity
of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 2nd day of June 2003,and
approved this 2nd day of June 2003.
