AN ORDINANCE TO AMEND CHAPTER 225.2,SUBSECTION K,
PERFORMANCE BOND,WAUKEE MUNICIPAL CODE,TO PROVIDE THAT
A SURETY OR CASH BOND SHALL BE FILED WITH THE CITY FOR
RESTORATION OF AREAS WITIDN THE RIGHT OF WAY AND ON UTILITY
EASEMENTS BY DELETING FROM THE HEADING THEREOF AND FROM
SAID SECTION THE WORDS,"PERFORMANCE BOND"AND BY ADDING
TO SAID SECTION THE WORDS "A CASH BOND SHALL BE HELD FOR 90
DAYS AFTER DATE OF COMPLETION".
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Chapter 225.2(K),Waukee Municipal Code,Performance Bond,is
hereby amended by deleting from the heading thereof and from said section the words,
"Performance Bond",and inserting in lieu thereof the words,"surety bond or cash
bonds";and by adding to said section the words,"a cash bond shall be held for 90 days
after date of completion".
Section 2.Repealer.All ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect
the validity ofthe ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its
final passage,approval and publication as provided by law.
Passed by the Council this 2nd day of June 2003,and approved this 2nd day of June
2003.
