AN ORDINANCE TO AMEND CHAPTER 213A,WAUKEE MUNICIPAL CODE OF
THE CITY OF WAUKEE,PROVIDING FOR THE ASSESSING OF FEES OR CHARGES FOR
THE COLLECTION,PROCESSING AND MARKETING OF SOLID WASTE AND
RECYCLABLE MATERIALS WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,
IOWA,TO INCREASE COLLECTION CHARGES FOR SINGLE FAMILY RESIDENCES
AND FOR A DWELLING OF TWO (2)OR THREE (3)UNITS,BY DELETING FROM
213A.3AAND 213A.3B "$12.14",AND INSERTING IN LIEU THEREOF "$12.39".
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Chapter 213A,Waukee Municipal Code,Assessing of Fees or Charges for the
Collection,Processing and Marketing of Solid Waste and Recyclable Materials Within the City
Limits of the City of Waukee,Iowa,is hereby amended by deleting from 213A.3A and from
213A.3b "$12.14",AND INSERTING IN LIEU THEREOF "$12.39"so that §213A.3 of Chapter
213A reads as follows:
§213A.3 Collection Charges.The fees or charges to pay for expenses
incurred in the collection,processing and marketing of solid waste and
recyclables shall be:
A.For each single family residence,twelve dollars and thirty-nine cents
($12.39)per month.
B.For a dwelling of two (2)or three (3)units,twelve dollars and thirty-nine
cents ($12.39)per month.
C.Any multi-family dwelling containing four (4)or more units having a
commercial type of container that may be mechanically emptied,and any
Mobile Home in a Mobile Home Park,must follow Waukee Municipal
Code provisions relating thereto,covering the mandating of Recycling at
Apartments and Mobile Home Parks.Disposition of solid waste from all
mobile homes,and recycling bins at multiple sites will be provided by
the Mobile Home Park owner,who shall be responsible for compliance
with ordinances of the City of Waukee regarding disposition of solid
waste and recycling.A fee of one dollar and seventeen cents ($1.17)per
month per unit will be billed by and paid to the City.
D.Recycling Containers.The fee to replace a lost or stolen container shall
be $8.00.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 6th day of October,2003 and approved
this 6th day of October,2003.
