RESOLUTION 2020-282
APPROVING DEED RESTRICTION [NORTHWEST HIGH SCHOOL/TRIUMPH PARK
STREAMBANK MITIGATION PROJECT]
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on June 25, 2018, the City entered into a formal agreement with the U.S. Army Corp of
Engineers related to channel mitigation as part of the Northwest High School and Triumph Park
Project; AND,
WHEREAS, a site was selected to the north of the Project to mitigate the impacted streambanks;
AND,
WHEREAS, a condition of the Section 404 permit between the City of Waukee and the U.S. Army
Corp of Engineers requires a deed restriction along 460 linear feet of the tributary to Little Walnut
Creek within the property located north of the Project to protect the mitigation site in perpetuity;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the Deed
Restriction [Northwest High School/Triumph Park Streambank Mitigation Project], attached hereto as
Exhibit A, is hereby approved.
BE IT FURTHER RESOLVED that the City Clerk is directed to record the Section 404 permit and
deed restriction plat exhibit with the Dallas County Recorder as required by the U.S. Army Corp of
Engineers.

You are authorized to perform work in accordance with the terms and conditions specified below
NOTE: The term "you" and its derivatives, as used in this permit, means the permittee or any future
transferee. The term "this office" refers to the appropriate district or division office of the Corps of
Engineers having jurisdiction over the permitted activity or the appropriate official of that office acting
under the authority of the commanding officer.
Project Description: Development of a high school campus and sports complex within the approximately
210 acre site located Y2 mile north of Hickman Road between 101h Street (U Avenue) and 41h Street,
Waukee. IA. The campus will include a new high school building, athletic fields, parking lots and ponds.
The project also includes the reconstruction of 10th Street west of the site and the creation of new
alignments of NW Douglas Parkway to the north, 411 Street to the east, 61h Street and NW Sunrise Drive
south of the proposed school campus. The construction of this complex will result in the permanent loss
of 0.91 acres of emergent wetland and the permanent impact of 350 linear feet of an unnamed perennial
stream.

Permit Conditions:
General Conditions:
1. The time limit for completing the work authorized ends on the date specified on page 1. If you
find that you need more time to complete the authorized activity, submit your request for a time
extension to this office for consideration at least one month before that date is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance
with the terms and conditions of this permit. You are not relieved of this requirement if you
abandon the permitted activity, although you may make a good faith transfer to a third party, in
compliance with General Condition 4 below. Should you wish to cease to maintain the authorized
activity or should you desire to abandon it without a good faith transfer, you must obtain a
modification of this permit from this office, which may require restoration of the area.
3. If you discover any previously unknown historic or archaeological remains while accomplishing
the activity authorized by this permit, you must immediately notify this office of what you have
found. We will initiate the Federal and state coordination required to determine if the remains
warrant a recovery effort or if the site is eligible for listing in the National Register of Historic
Places.
4. If you sell the property associated with this permit, you must obtain the signature of the new
owner in the space provided and forward a copy of the permit to this office to validate the transfer
of this authorization.
5. If a conditioned water quality certification has been issued for your project, you must comply with
the conditions specified in the certification as special conditions to this permit. For your
convenience, a copy of the certification is attached if it contains such conditions (Condition is not
applicable for Section 10 Permits).
6. You must allow representatives from this office to inspect the authorized activity at any time
deemed necessary to ensure that it is being or has been accomplished in accordance with the
terms and conditions of your permit.
Special Conditions:
You shall adhere to the mitigation plan provided to the Corps May 161", 2017 which includes
mitigation for the permanent impact of 350 linear feet of stream and the performance standards
within. The improved stream reach, totaling 460 linear feet, will include at least two riffle
structures with 50 foot average width buffers on 250 linear feet. The buffer created in conjunction
with the stream mitigation site will be 50 feet wide on average from the top of bank and exhibit
less than a 5% invasive/noxious weed cover with no areas of 100 square feet or larger that are
dominated by weed species.
2. To offset the unavoidable impacts to jurisdictional wetlands located within the project area you
shall purchase 0.91 emergent acre/credits at either the McCorkle Wetland Mitigation Bank or
Voas Mitigation Bank
3. You are responsible for insuring that whoever performs, supervises, or oversees any portion of
the physical work associated with the construction of the project has a copy of, is familiar with,
and complies with all the terms and conditions of this permit.
4. The General Conditions and the Mitigation Conditions in the Attached Section 401 Water Quality
Certification from the Iowa Department of Natural Resources are considered Special Conditions
of this permit.
The permittee shall monitor the completed stream mitigation sites for a minimum period of five
years. You shall provide an annual report to the Corps of Engineers documenting the extent and
success of the mitigation completed. The permittee shall conduct an annual survey of the stream
mitigation areas to monitor the success of stream buffer plantings, grade stabilization structures
and bank stabilization work. The surveys shall be conducted during the growing season, and
shall commence during the first full growing season following mitigation site construction and
planting. The results of the survey will be documented annually on the Rock Island District
Standard Mitigation Reporting Form available at: "ttP_i_/www2 mvr usace army mil/Regulatory" or
in an annual progress report as specified in RGL 06-03,

due no later than December 31 of each year for the 5-year monitoring period. All annual
monitoring reports shall be formatted for an 8.5 x 11 inch piece of paper. The mitigation
monitoring reports shall be submitted to the Iowa Department of Natural Resources and to the
Corps of Engineers.
6. Prior to construction, a signed financial assurances instrument and a signed site protection
document (such as a conservation easement or deed restriction) shall be provided to the Corps
for the stream mitigation area within 30 days of completion. Activities such as but not limited to:
future construction for commercial or private use, agricultural practices such as farming or
livestock staging/grazing, mineral resource excavation, transportation facilities such as bridges,
roads and parking lots, billboards, etc. shall be added as prohibited activities on the deed
restriction.
To prevent the spread of non-native and/or invasive plant species, the permittee shall ensure that
equipment used at all wetland and waterway crossings is cleaned before arriving on site. Wash
water shall not be discharged into any wetland, waterway, or any other surface water
conveyances.
8. If construction work uncovers an item or items that may be of historic or Archeological interest or
if important new historical data comes to light in the project area, the work will be delayed
sufficient time to notify the U. S. Army Corps of Engineers, Rock Island District, Clock Tower
Building — Post Office Box 2004, Rock Island, Illinois 61204-2004 (telephone 309/794-5367), and
the State Historical Society of Iowa, Bureau of Historic Preservation, Historical Building/Capital
Complex, Des Moines, Iowa 50319 (telephone 515/281-5111), and to allow the significance of the
discovery to be determined. The permittee may be held responsible for cost associated with
identification and recovery.
9. Your project must adhere strictly to the mitigation plan that was submitted. If plans must be
modified and impacts to Waters of the United States are increased you are required to notify and
apply for a permit modification from the Corps and Iowa DNR prior to commencing any activities.
10. You are encouraged to conduct your construction activities during a period of low flow. You are
required to remove all fill material used as a temporary crossing, causeway, or work pad to
upland, non -wetland site, to seed all disturbed areas with native grasses, and to implement
appropriate measures to insure that sediments are not introduced into waters of the United States
during construction of this project.

1. Congressional Authorities: You have been authorized to undertake the activity described
above pursuant to:
( ) Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403).
( X ) Section 404 of the Clean Water Act (33 U.S.C. 1344).
( ) Section 103 of the Marine Protection, Research and Sanctuaries Act of 1972
(33 U.S.C. 1413).
2 Limits of this authorization.
a. This permit does not obviate the need to obtain other Federal, state, or local authorizations
required by law.
b. This permit does not grant any property rights or exclusive privileges.
c. This permit does not authorize any injury to the property or rights of others.
d. This permit does not authorize interference with any existing or proposed Federal project.
3. Limits of Federal Liability. In issuing this permit, the Federal Government does not assume
any liability for the following:
a. Damages to the permitted project or uses thereof as a result of other permitted or
unpermitted activities or from natural causes.
b. Damages to the permitted project or uses thereof as a result of current or future activities
undertaken by or on behalf of the United States in the public interest.
c. Damages to persons, property, or to other permitted or unpermitted activities or structures
caused by the activity authorized by this permit.
d. Design or construction deficiencies associated with the permitted work.

4. Reliance on Applicant's Data: The determination of this office that issuance of this permit is
not contrary to the public interest was made in reliance on the information you provided.
5. Reevaluation of Permit Decision. This office may reevaluate its decision on this permit at any
time the circumstances warrant. Circumstances that could require a reevaluation include, but are not
limited to, the following:
a. You fail to comply with the terms and conditions of this permit.
b. The information provided by you in support of your permit application proves to have been
false, incomplete, or inaccurate (See 4 above).

c. Significant new information surfaces which this office did not consider in reaching
the original public interest decision
Such a reevaluation may result in a determination that it is appropriate to use the suspension,
modification, and revocation procedures contained in 33 CFR 325.7 or enforcement procedures such as
those contained in 33 CFR 326.4 and 326.5. The referenced enforcement procedures provide for the
issuance of an administrative order requiring you to comply with the terms and conditions of your permit
and for the initiation of legal action where appropriate. You will be required to pay for any corrective
measures ordered by this office, and if you fail to comply with such directive, this office may in certain
situations (such as those specified in 33 CFR 209.170) accomplish the corrective measures by contract or
otherwise and bill you for the cost.
6. Extensions General condition 1 establishes a time limit for the completion of the activity
authorized by this permit. Unless there are circumstances requiring either a prompt completion of the
authorized activity or a reevaluation of the public interest decision, the Corps will normally give favorable
consideration to a request for an extension of this time limit.

by installing at least two riffle structures with 50 foot average width buffers on 2S0 linear feet. The buffer created in
conjunction with the stream mitigation site will be 50 feet wide on average from the top of bank and exhibit less than a
5% invasive/noxious weed cover with no areas of 100 square feet or larger that are dominated by weed species. To
mitigate for the unavoidable impacts to 0.91 acre of jurisdictional wetlands located within the project area, the City of
Waukee and the Waukee Community School District shall purchase 0.91 emergent wetland credit at either the McCorkle
Wetland Mitigation Bank or Voas Mitigation Bank.
Water quality use designation:
This reach of a tributary to Little Walnut Creek is designated as Class Al Primary contact recreational use. These are
waters in which recreational or other uses may result in prolonged and direct contact with the water, involving
considerable risk of ingesting water in quantities sufficient to pose a health hazard. This reach of a tributary to Little
Walnut Creek is also designated as Class B(WW-1) which are waters in which temperature, flow and other habitat
characteristics are suitable to maintain warm water game fish populations along with a resident aquatic community that
includes a variety of native nongame fish and invertebrate species. All surface waters in Iowa, including wetlands and
those designated for Class "A"; "B", and/or "C" are classified for the following general uses: livestock & wildlife watering,
noncontact recreation, crop irrigation, and industrial, agricultural, domestic, and other incidental withdrawal uses.
The Iowa Department of Natural Resources (Iowa DNR) has issued this State 401 Water Quality Certification
(Certification) pursuant to Section 401 of the Clean Water Act. The Army Corps of Engineers (Corps) requires state
Certification before a Section 404 permit can be issued. Section 401 Certification represents the Iowa DNR's concurrence
that the project certified is consistent with the Water Quality Standards of the state of Iowa as set forth in Chapter 61,
Iowa Administrative Code.
Subject to the attached conditions, incorporated by reference herein, the Iowa DNR has determined that there is
reasonable assurance the proposed activities will be conducted in a manner that will not violate water quality standards
of the state of Iowa.

GENERAL CONDITIONS
1. Prior to construction, the City of Waukee and the Waukee Community School District is responsible for securing
and for compliance with such other permits or approvals as may be required by the Iowa DNR, federal, state, or
local governmental agencies for the project activities described.
2. To prevent the spread of non-native and/or invasive plant species, the City of Waukee and the Waukee
Community School District shall ensure that equipment used at all wetland and waterway crossings is cleaned
before arriving on site. Wash water shall not be discharged into any wetland, waterway, or any other surface
water conveyances.
3. You are encouraged to conduct your construction activities during a period of low flow.
4. Clearing of vegetation, including trees located in or immediately adjacent to waters of the state, shall be limited
to that which is absolutely necessary for construction of the project. All vegetative clearing material shall be
removed to an upland non -wetland disposal site.
5. All construction debris shall be disposed of on land in such a manner that it cannot enter a waterway or wetland.
Construction equipment, activities, and materials shall be kept out of the water to the maximum extent
possible. Equipment for handling and conveying materials during construction shall be operated to prevent
dumping or spilling the material into waterbodies, streams or wetlands except as approved herein. Care shall be
taken to prevent any petroleum products, chemicals, or other deleterious materials from entering waterbodies,
streams or wetlands.
Erosion control features (i.e., silt fences, silt ditches, silt dikes, silt basins, etc.) must be installed to provide
continuous erosion control throughout the construction and post construction period as well as the
revegetation of all disturbed areas upon project completion. Where siltation control features have been reduced
in capacity by 50% or more, the features shall be restored to their original condition with a minimum of delay.
All disturbed areas not covered with riprap shall be seeded with native grasses, excluding Reed Canarygrass
(Pholaris arundinacea) or any aggressive or invasive species, during an optimal seeding period. If excavation and
construction are completed outside an optimal seeding period, temporary erosion control protection shall be
implemented immediately upon completion of excavation and construction and shall be maintained until such
time as seeding can be completed during an optimal period. The permittee shall monitor revegetated areas
continuously to assure success of revegetation. If rye is initially planted to stabilize the soil then native warm
season grasses shall be planted during the following growing season.
8. Riprap shall consist of clean native fieldstone, clean quarry run rock or clean broken concrete. If broken concrete
is used, all reinforcement material shall be completely removed from it; if removal is not possible, said
reinforcement material shall be cut flush with the flat surface of the concrete. It shall be the permittee's
responsibility to maintain the riprap such that any reinforcement material that becomes exposed in the future is
removed. The concrete pieces shall be appropriately graded and no piece shall be larger than 3 feet across the
longest flat surface. No asphalt or petroleum based material shall be used as or included in riprap material.
Mitigation
To mitigate for the permanent impact of 350 linear feet of stream, a total of 460 linear feet of stream will be
improved by constructing at least two riffle structures with 50 foot average width buffers on 250 linear feet.
The buffer created in conjunction with the stream mitigation site will be 50 feet wide on average from the top of
bank and exhibit less than a 5% invasive/noxious weed cover with no areas of 100 square feet or larger that are
dominated by weed species.
2. Within 30 days of completion of construction of the mitigation site, a signed financial assurances instrument, a
signed site protection document (such as a conservation easement or deed restriction), a copy of the Section
404 Permit and Section 401 Water Quality Certificate will be filed at the Dallas County recorder's office and
copies provided to the Iowa DNR and to the Corps.
3. Mitigation work shall begin concurrent with the initiation of project construction. The City of Waukee and the
Waukee Community School District will notify the Corps and Iowa DNR in writing upon the completion of the
stream mitigation. An as -built plan shall be submitted to the Iowa DNR and to the Corps upon completion.
4. The City of Waukee and the Waukee Community School District shall monitor the completed stream mitigation
sites for a minimum period of five years. You shall provide an annual report to the Iowa DNR and Corps of
Engineers documenting the extent and success of the mitigation completed. The City of Waukee and the
Waukee Community School District shall conduct an annual survey of the stream mitigation areas to monitor the
success of stream buffer plantings, grade stabilization structures and bank stabilization work. The surveys shall
be conducted during the growing season, and shall commence during the first full growing season following

6. The City of Waukee and the Waukee Community School District shall assume all liability for accomplishing any
needed corrective work.
