Home My WebLink About2002-04-15-Resolutions 02-67_Library Facility - Easement Agr - MidAmerican EnergyTHE CITY OF WAUKEE,lOW A RESOLUTION 02-67 APPROVING THE EASEMENT AGREEMENT WITH MIDAMERICAN ENERGY FOR EXTENSION OF ELECTRICAL SERVICE TO THE WAUKEE PUBLIC LIBRARY IN THE NAME AND BY THE AUTHORiTY OF THE CITY OF WAUKEE,IOWA WHEREAS,Rochon Corporation has begun construction of the Waukee Public Library AND, WHEREAS,electrical service must be supplied to the work site to continue construction AND, WHEREAS,MidAmerican Energy will provide electrical service as soon as an easement granting MidAmerican Energy the right to lay,maintain,operate,repair,and remove underground conduit,wires and other necessary equipment incident thereto (including associated surface mounted equipment)through and across certain property legally described as: An underground electric line easement consisting of a strip of land ten (10)feet in width,situated in the property described as follows:the East 636.7 feet of the South 347 feet of the North 1307 feet of the Northeast Quarter of the Southeast Quarter (NESE)of Section 33, Township 79 North,Range 26 West of the 5th P.M.,Dallas County,Iowa; said property contains 4.81 acres,more or less;the centerline of said electric line easement being more particularly described as follows: Beginning at a point on the Westerly right-of-way line of Warrior Lane,as it is presently established,that is 36 feet,more or less,North of the South property line;thence Westerly 248 feet,more or less;thence Northwesterly 145 feet,more or less,to the Point of Termination at a pad- mounted transformer,as generally depicted on Exhibit "A",attached hereto and made a part hereof Together with ingress and egress to and from the same;AND, WHEREAS,MidAmerican Energy has stated in the easement agreement that they will move the electrical service at the request ofthe City for construction or modification of the Waukee Public Library Site,if and when growth or need necessitates such a move. NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 15th day of April 2002 that it hereby approves the easement agreement with MidAmerican Energy for extension of electrical service to the Waukee Public Library.
