RESOLUTION 02-74A
APPROVING AGREEMENT BETWEEN CITY AND DEVELOPER FOR
CONSTRUCTION OF IMPROVEMENTS AND REIMBURSEMENT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City has requested Joseph S.Brick,developer of Joe Brick
Industrial/Business Park,undertake the construction of a twelve-inch water main and
associated improvements to be installed commencing at Laurel Street,extending
southerly approximately parallel with proposed Brick Drive and ending at the south
boundary line ofthe developer's property;AND,
WHEREAS,the City and the Developer,Joseph S.Brick,agree that the proposed new
water main will be connected to the existing water main trunk line along the south
boundary line of Joe Brick IndustriallBusiness Park to improve water flow characteristics
to existing and future developments in the Park AND,
WHEREAS,the City will advance the costs of the project and oversee the project to
ensure it is constructed in conformity with all plans and specifications;AND,
WHEREAS,the City after submitting a detailed and itemized statement of all the actual
construction costs for the project,will expect reimbursement from the developer Joe
Brick at the earliest of (I)date of approval of the Final Plat or (2)Five (5)years after the
date of submittal to the developer an itemized statement of actual construction costs.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 6th day of May,2Q02 that it hereby approves the agreement between the City
and the developer,Joseph S.Brick,for construction of improvements and reimbursement
of the costs of construction of those improvements in the Joe Brick Industrial/Business
Park.
