generally of the following described sanitary sewer improvements which shall be located
with terminal points as follows:
RESOLUTION NO.03-11
Resolution ofNecessity
WHEREAS,this Council has adopted a preliminary resolution in accordance with
Section 384.42 of the Code of Iowa,covering the R-22 Sanitary Sewer Improvements
Project (the "Project");and
WHEREAS,pursuant thereto,the Project Engineers have prepared preliminary
plans and specifications,an estimated total cost of the work and a plat and schedule,
including the valuation of each lot as determined by this Council,and the same have been
duly adopted and are now on file with the City Clerk;
NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,
Iowa:
Section 1.It is hereby found and determined to be necessary and for the best
interest of the City and its inhabitants to proceed with the Proj ect,and to assess a portion
of the cost to the property benefited thereby.
Description of Improvements
Zone 1 includes a 0.150 million gallons per day pump station,
approximately 665 linear feet of 12-inch diameter sanitary sewer pipe,
approximately 11,077 linear feet of 4-inch to 6-inch diameter force main,
approximately 10,592 linear feet of l2-inch diameter force main,
manholes,drop connections,surface restoration and miscellaneous
associated work.
Zone 2 includes a 0.150 million gallons per day pump station,
approximately 1,835 linear feet of l4-inch to 16-inch diameter sanitary
sewer pipe,approximately 88 linear feet of 4-inch diameter force main,
manholes,drop connections,surface restoration and miscellaneous
associated work.

ZONE 2
A IS-inch diameter sanitary sewer begins at the above described manhole
and extends northerly along the west side of County Road R-22
approximately 1,830 feet.The IS-inch sewer discharges into Pump
Station No.1 which located approximately 250 feet north of Cottonwood
Drive.A 4-inch diameter force main begins at Pump Station No.1 and
extends northerly along the west side of County Road R-22 approximately
88 feet to a point on the boundary separating Zone 2 and Zone 1.
ZONEl
The 4-inch diameter force main continues northerly along the west side of
County Road R-22 from the above described point approximately 1,965
feet to a branch in the 4-inch force main.One branch of the force main
discharges into a manhole just south of Ashworth Drive.A 12-inch
diameter sanitary sewer begins at the above described manhole and
extends northerly along the west side County Road approximately 665 feet
where it discharges into Pump Station No.2.The other branch of the 4-
inch force main continues northerly along the west side of County Road
R-22 to a point just north of Pump Station No.2 where it connects with a
6-inch diameter force main.The (i-inch diameter force main begins at
Pump Station No.2 and extends northerly along the west side of County
Road R-22 approximately 7,840 feet.The force main then extends east
across County Road R-22 to the wastewater treatment facility where it
eventually discharges into an existing manhole.The 12-inch diameter
force main begins 210 feet north of Pump Station No.I and extends
northerly along the west side of County Road R-22 approximately 10,525
feet.The force main then extends east across County Road R-22 where it
terminates approximately 25 east of the road.
It is considered that the property within the following described boundaries will
be specially benefited by this improvement and should be specially assessed:
That part of a tract ofland which lies between the west right of way line of
County Road R-22 and a line 300 feet west of and adjacent to the west
right of way line of County Road R-22 as presently established of that part
of a tract ofland referred to as tract A for purposes of this description only
in the west half of the southwest quarter of said Section 8 and with said
tract A described as follows:Beginning at the west quarter comer of said
Section 8;thence north 82°58'40"east,a distance of 1,312.93 feet to the
west right of way of County Road R-22;thence south 0°33'42"west,a
distance of 129.36 feet along the west right of way of County Road R-22;
thence south 83°10'00"west,a distance of 500.0 feet;thence south
0°33'42"west,a distance of 450.0 feet;thence north 83°10'00"east,a
distance of 449.64 feet to the west right of way of County Road R-22;
thence south 0°33'42"west,a distance of 729.37 feet along the west light
of way of County Road R-22;thence south 2°56'00"west,a distance of
158.60 feet;thence south 9°11'00"west,a distance of 151.5 feet;thence
south 0°17'00"west,a distance of 150.00 feet;thence south 31°40'00"
west,a distance of 146.50 feet;thence south 56°34'00"west,a distance of I
ZONEl
An area in the west half of Sections 5 and 8,Township 78 North,Range
26 West of the 5th P.M.,City of Waukee,Dallas County,Iowa,more
particularly described as follows:
That part of each tract of land described below in the west half of said
Section 5 which lies between the east light of way of County Road R-22
(also known as Ute Avenue and 6th Street)and a line 300 feet east of and
adjacent to the east right of way line of County Road R-22 as presently
established,with said tracts described as follows:Govemment Lot 4,
except Parcel A,Band C;Govennnent Lot 5;Government Lot 12 except
that part lying south of3l2'h Place.
Also that part of Government Lot 12 which lies between County Road R-
22 west right of way and a line 300 feet west of and adjacent to the west
right of way line of County Road R-22 in said Section 5.
Also that part of the southeast quarter of the northwest quarter of said
Section 8,which lies between the east right of way of County Road R-22
and a line 300 feet east of and adjacent to the east light of way line of
County Road R-22 as presently established,except the south 635 feet
thereof.
ZONE 2 I
An area in the west half of Section 8,Township 78 North,Range 26 West
of the 5th P.M.,City of Waukee,Dallas County,Iowa,more particularly
described as follows:
299.50 feet;thence south 62°24'00"west,a distance of252.70 feet;thence
south 55°50'00"west,a distance of 443.20 feet;thence south 70°33'00"
west,a distance of 329.8 to a point on the west line of said Section 8;
thence northerly along the said west line to the point of beginning of said
tract A.
Also the south 635 feet of the southeast quarter of the northwest quarter of
said Section 8 and that part of the east half of the southwest quarter of said
Section 8 north of the westbound Interstate 80 off-ramp in said Section 8
which lies between the east right of way of County Road R-22 and a line
300 feet east of and adjacent to the east right of way line of County Road
R-22 as presently established.
Except a parcel of land in said Section 8 described as follows:
Commencing as a point of reference at the center of said Section 8;thence
south 82°58'40"west along the south line of the northwest quarter of said
Section 8,distance of 810.24 feet to the point of beginning;thence south
0°33'42"west a distance of 189.21 feet;thence south 67°04'41"west a
distance of 544.20 feet;thence north 0°33'42"east a distance of 339.61
feet;thence north 0°02'17"east a distance of 397.80 feet;thence south
61 °03'32"east a distance of 570.84 feet;thence south 0°02'17"west,a
distance of 60.00 feet to the point of beginning.

particularly descr'as follows:
That part of a tract described as an official replat of Lot 5,in the
Auditor's Plat of the north:quarter 0 orthwest quarter of said
Section 17,whic1 .~tween the west right of way 0 unty Road R-22
and a r feet west of and adj acent to the west right 0 ine of
nty Road R-22 as presently established.
Section 3.It is hereby found and determined that there are now on file in the
office of the City Clerk an estimated total cost of the proposed work and a preliminary
plat and schedule showing the amount proposed to be assessed to each lot by reason of
the Project.
Section 4.Unless a property owner files objections with the City Clerk at the
time of the hearing on this resolution of necessity,the property owner shall be deemed to
have waived all obj ections pertaining to the regularity of the proceedings and the legality
of using the special assessment procedure.
Section 5.All resolutions,parts of resolutions,or actions of the Council in
conflict herewith are hereby repealed,to the extent of such conflict.
