RESOLUTION 02-144
APPROVING WITHDRAWAL OF SWALLOW/SHAFFER PROPERTY
INVOLUNTARY ANNEXATION PETITION FROM FURTHER CONSIDERATION BY
THE CITY DEVELOPMENT BOARD
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee Council in session October 15,2001 approved the petition for
an involuntary annexation of the Swallow/Shaffer properties;AND,
WHEREAS,that petition was submitted to the City Development Board and placed on the
December 13,2001 Agenda;AND,
WHEREAS,the City Development Board tabled action on the involuntary petition until January
17,at which meeting the CDB resumed consideration ofthe involuntary annexation;AND,
WHEREAS,the City Development Board did not dismiss the involuntary petition at its January
17 meeting and requested the appointment of a representative from the City of Waukee to be part
of the Special City Development Committee for the Swallow/Shaffer property proposed for
annexation to Waukee;AND
WHEREAS,the initial meeting of the Special City Development Committee scheduled for
March 14,2002 was yet to occur when the City of Waukee requested a postponement of that
hearing which was scheduled to gather input on the petition for involuntary annexation of the
Swallow/Shaffer property;AND
WHEREAS,the hearing of the Special City Development Committee on March 14,2002 was
postponed by the City Development Board and not dismissed;AND
WHEREAS,the involuntary annexation petition must be withdrawn by the City of Waukee
before the City Development Board will close the file on the involuntary annexation petition of
the Swallow/Shaffer properties and proceed with the most recent voluntary annexation petition
of properties including the Swallow/Shaffer properties,
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
23rd day of September 2002 that it hereby approves the withdrawal of the Swallow/Shaffer
property involuntary annexation petition from further consideration by the City Development
Board of the State ofIowa.
