THE CITY OF WAUKEE,IOWA
APPROVING A PROVISION FOR A TRANSITION FOR THE IMPOSITION OF
TAXES FOR PROPERTY PREVIOUSLY ANNEXED
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the property located at 3336 Ashworth Road was approved as P81t of City of
Waukee annexation by the City Development Board on October 11,2001;AND,
WIIEREAS,the property,as annexed at the time,did not include a dwelling and was not
eligible for the provision for a transition for the imposition of taxes as provided in Section
368.11,subsection 13 of the Iowa Code;AND,
WHEREAS,during the original negotiation and discussion prior to annexation,MI.Cross
understood that he was entitled to transitional tax exemption for his property regardless of
whether the property included a dwelling;AND,
WHEREAS,during the last two years,a home has been built on the property for which Mr.
Cross had requested transitional tax exemption;AND,
1WHEREAS,MI.Cross is now eligible for the annexation provision for transition for the
imposition of taxes starting with the second year of the five year period for partial exemption
from taxes;AND,
WHEREAS,city staff have reviewed the issue with Dallas County personnel and recommend
approving the transitional tax relief for the property located at 3336 Ashworth Road beginning
with the second year or 60%.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
6th day of October 2003 that it hereby approves providing Mr.Cross with the provision which
allows for the transition for the imposition oftaxes as provided in Section 368.11(13)and
Section 427B.3 of the Iowa Code.
