RESOLUTION 03-210
APPROVING AN AMENDMENT TO AN EASEMENT FOR A GAS LINE WITH
THE DALLAS COUNTY BOARD OF SUPERVISORS AND THE DALLAS
COUNTY CONSERVATION BOARD TO REFLECT A CHANGE IN THE TERM
OF THE AGREEMENT FROM 25 YEARS TO A PERPETUAL EASEMENT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City Council of the City ofWaulcee approved Resolution 03-184 on
August 20,2003,which resolution approved an Easement for a Gas Line with the Dallas
County Board of Supervisors and the Dallas County Conservation Board for twenty-five
(25)years over,under,through and across the following described real estate:
A tract ofland previously Quit Claimed from the Iowa Natural Heritage
Foundation,an Iowa Corporation,to Dallas County,Iowa,as recorded in Book 2001,
page 568 with said easement being the north half of that part of the previously described
tract ofland in Book 2001,page 568,described as all of the property of the Chicago and
Northwestern Transportation Company lying in the south half of the South Half of
Section 29,(and the North Half ofthe North Half of Section 32,if any)all in Township
79 North,Range 26 West of the Fifth Principal Meridian,Dallas County,Iowa,and
further limited for the purposes of grant of easement at the eastern boundary by COUlIty
Road R22 or U Ave,and forming the western boundary by County Road T Avenue;
AND,

WHEREAS,the Dallas County Board of Supervisors approved this agreement in
Resolution 2003-107,August 19,2003 and changed the length of the term of this
agreement from twenty-five years (25)to perpetual and corrected the street number from
R16 to R22 in a motion moved by Brad Golightly and seconded by Kim Chapman,
September 2,2003;AND,
WHEREAS,all other requirements or conditions of this Gas Line Easement remain
basically the same without significant changes or modifications;such Gas Line
Easement,recorded in Book 2003,Page 17456,shall reflect the change in the term ofthe
agreement from twenty-five (25)years to a perpetual easement;AND,
WHEREAS,a copy of said easement with the term modified from 25 years to a
perpetual easement is attached hereto and made a part herein.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 20th day of October 2003 that it hereby approves the change in term length of
the Gas Line Easement with Dallas County from twenty-five (25)years to a perpetual
easement,which change in length oftenn was approved by the Dallas County Board of I
Supervisors on September 2,2003 and later approved by the Dallas County Conservation
Board.
