RESOLUTION 03-125
APPROVING PETITION,CONTRACT AND WAIVER AGREEMENT WITH
WARREN HUNSBERGER,CHARLES GABUS AND FRANK SCAGLIONE WITH
RESPECT TO THE R22 SANITARY SEWER IMPROVEMENTS PROJECT
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Bob Josten of the Law Finn:Dorsey &Whitney has prepared the "Petition,
Contract and Waiver"Agreement for all property owners interested in developing their
properties and in connecting to the R22 Sanitary Sewer;AND,
WHEREAS,Mik Briedis,Project Engineer,of Veenstra &Kimm,Inc.has reviewed and
prepared the legal description and calculated the percentage cost and benefit for all property
owners;AND,
WHEREAS,Mr.Frank Scaglione,Mr.Warren Hunsberger and Mr.Charles Gabus are each
satisfied with the agreement as written and approved by their personal attorneys;AND,
WHEREAS,all property owners participating in this proj ect have signed their respective
Petition,Contract and Waiver Agreement and agree that this Agreement shall constitute a written
contract and petition as required by Section 384.41 of the Code of Iowa,for the initiation of a
plan for a public improvement to be paid in whole or in part by special assessments to be levied
against the Land of the Property Owner;AND,
WHEREAS,city staff except and approve all four agreements with respect to the R22 Sanitary
Sewer Improvements Proj ect and attach a copy of each agreement to this resolution excluding
from each a copy of Exhibit D -2003 Assessment Preliminary Plat and Schedule,a copy of
which can be found in the project folder.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
2nd day of June 2003 that it hereby approves the Petition,Contract and Waiver Agreements with
Warren Hunsberger,Charles Gabus,and Frank Scaglione with respect to the R22 Sanitary Sewer
