RESOLUTION 03-139
APPROVING THE TIDRD AMENDMENT TO
WATER SERVICE AGREEMENT WITH DMWW
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee and Water Board now desire to terminate the First Amendment
and Second Amendment and for Water Board to provide services as set forth in the Third
Amendment to Water Services Agreement;AND,
WHEREAS,the Water Board will design,establish and implement a system whereby it will
perform meter reading services to Waukee to consist of a monthly read of each of the meters of
each of Waukee's customers and the collection,compilation and delivery of such data;AND,
WHEREAS,the term of such services shall automatically renew for successive one (1)year
terms commencing on July 1 of each year,subject to the right of either party to give written
notice of termination to the other not less than ninety (90)days prior to the date of termination;
AND,
WHEREAS,all services Water Board performs for Waukee under this Third Amendment are to
be performed by Water Board in its capacity as an independent contractor,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa
that the Third Amendment to Water Service Agreement be approved.
Passed by the City Council of the City of Waukee,Iowa,and approved the 16th day of June 2003.
