APPROVING THE LAND EXCHANGE WITH ROGER SCHLAEFER AND
ESTABLISHING AN EASEMENT FOR COMMUNITY ADMITTANCE ON THE
NORTH SIDE OF THE SCHLAEFER PROPERTY TO PROVIDE ENTRANCE INTO
SONG BIRD PARK AND THE FUTURE TRAIL TO BE LOCATED ALONG THE
CREEK
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Roger and Marge Schlaefer approached the Park Board and the City Council to
purchase parkland along the rear of their lot in order to meet the building set-back requirements
to build a sun porch onto the back of their home so they may enjoy Song Bird Park;AND,
WHEREAS,the City requested an exchange with Mr.And Mrs.Schlaefer for a 15 foot Access
Easement on the north end of their property to provide public access to the Song Bird Park and
future trail system;AND,
WHEREAS,the City would abandon the existing access easement which currently lies in part
under the Schlaefer's garage;]
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa
that the land exchange with Roger Schlaefer and the establishment of and easement for
community admittance on the north side of the Schlaefer property to provide entrance into Song
Bird Park and future trail to be located along the creek be approved.This exchange is a transfer
of property of 15'on the north side of the Schlaefer property to the City and a transfer of 15'
from the City to the Schlaefers on the east side of the Schlaefer property.
Passed by the City Council of the City of Waukee,Iowa,and approved the 7th day ofJuly 2003.
