RESOLUTION 03-89
APPROVING PAYMENT TO ROCHON CORPORATION OF IOWA,INC.
IN THE AMOUNT OF $47,916.10 ($62,916.10,THE SUM OF AMOUNTS
PREVIOUSLY WITHHELD FROM PAY APPLICATIONS 9,10 AND 12
MINUS $15,000 WITHHELD FOR ROOFING)
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,due to deficiencies in the construction ofthe Library and due to the tardiness in the
assessment and correction of those deficiencies,the City of Waukee withheld portions of pay
applications 9 and 10 and all of pay application 12;AND,
WHEREAS,the amounts withheld were:
Pay Application #9
Pay Application #10
Pay Application #12
for a total of$62,916.10;AND,
$3,573.00
$10,000.00
$49,343.10
WHEREAS,City Staff feel the corrections made or to be made and the credit received were
adequate to correct the problems which were responsible for the council withholding partial
payment for Pay Applications 9 and 10 and all of Pay Application 12;AND
WHEREAS,Councilmen Mike Watts and Don Bailey are hesitant to pay the full amount dne
Rochon Corporation oflowa,Inc.as long as they remain unsure of the repair ofthe roof.
NOW THEREFORE BE IT RESOL YED by the City of Waukee City Council in session this
215t day of April 2003 that it hereby approves payment to Rochon Corporation oflowa in the
amount of $47,916.10 ($62,916.10 minus $15,000 withheld until problem corrected.)
