RESOLUTION 04-143
APPROVING ANNEXATION PETITIONS FROM KURT BREWER,STEVEN GRUBB
AND THE BRODERICK FAMILY AND SETTING JULY 26,2004 AS THE DATE FOR
A PUBLIC HEARING ON AN 80/20 ANNEXATION
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Kurt Brewer,sole owner of property legally described as follows
Govemment Lot 12 and South 33 feet of Lot 5 all in Section 4,
Township 78 North,of Range 26 West of the 5th P.M.,Dallas County,
Iowa,EXCEPT beginning 184.4 feet South of an Iron Pin at the
Northwest Comer of Govemment Lot 12 in Section 4-78-26 West of
the 5th P.M.,Dallas County,Iowa,thence East 358.8 feet,thence North
261.4 feet,thence Southwesterly (bearing South 87 degrees 4/W)on a
line 33.0 feet North of and Parallel to the North line of said
Govemment Lot 12 359.6 feet to the West section line of Said Section
4,thence South 217.4 feet to the point of beginning,
has submitted petition for voluntary annexation to the City of Waukee;AND,
WHEREAS,Stephen R Grubb,Boardwalk Development,L.L.C owner of property legally
described as follows:
Govemment Lot 8 in Section 5,Township 78 North,Range 26 West of
the 5th P.M.,Dallas County,IA;more completely described as:
Beginning at the SE Comer of said Govemment Lot 8;Thence
NOo03l '39"E along East line of said Govemment Lot 8,1310.46 feet
to the NE comer of said Govemment Lot 8;Thence N83°28'44"E
along North line of said Govemment Lot 8,1318.44 feet to the NW
comer of said Govemment Lot 8;Thence S00034'18"W along the
East line of said Govemment Lot 8,1309.11 feet to the SW comer of
said Govemment Lot 8,Thence N83°32'32"E along South line of said
Govemment Lot 8,1319.28 to the point of beginning.Said Parcel
contains 39.36 acres including 0.99 acres County Road Right Of Way
and is subj ect to easements of record
have submitted a petition for voluntary annexation to the City of Waukee;AND,

WHEREAS,the Broderick Family consisting of Bridget E.Broderick,a single person,Brian
Broderick and Cheryl J.Richardson,husband and wife,Michael J.Broderick and Rochelle
Broderick,husband and wife,Renae F.Broderick and Douglas Bordewieck,wife and husband,
Diane M.Broderick and James Russell,wife and husband,Timothy P.Broderick and Teresa
Broderick,husband and wife,Kathleen B.Quam and David Quam,wife and husband,and John
E.Broderick and Barbara,husband and wife,owners and sellers of property legally described as:
Govemment Lots 6,7,10 and II of Section 5,Township 78 North,
Range 26 West of the 5th P.M.,Dallas County,Iowa
and buyer,Hubbell Realty Company,have submitted petitions for voluntary annexation to the
City of Waukee;AND,

WHEREAS,all three property owners comprise approximately 238 acres in the rural area south
central of Waukee proper;AND,
WHEREAS,City staff recommend accepting voluntary annexation petitions for all three
properties;AND,
WHEREAS,annexation of these three properties creates an island consisting of approximately
44 acres in total;AND,
WHEREAS,the Iowa Code Section 368.7(3)expressly prohibits creating an island in the
process of annexation;AND,
WHEREAS,the Iowa Code Section 368.7(1)provides Cities with the 80120 annexation
mechanism,which in this instance permits cities to annex real estate consisting of 80%of the
land submitted on voluntary petitions and 20%of the land included in a non-consenting portion
of the annexation;AND,
WHEREAS,the City of Waukee is prepared to consider an 80/20 annexation of the above
mentioned properties comprising approximately 238 acres and properties owned by:Stanley and
Jayne Venard,Mark and Pamela Venard,Jim and Carolyn Hermann,Jim Herman,Kathleen
Michael and Nancy Hines,Marvin and Iva Terry,Randolph Allison and Michael Phillips
comprising approximately 44 acres;AND,
WHEREAS,City Staff recommend setting July 26,2004 as the date of a public hearing to
consider approval of this 80120 Annexation Petition.
NOW THEREFORE BE IT RESOL YED by the City of Waukee City Council in session this
21 st day of June 2004 that it hereby approves the three voluntary petitions for annexation to the
City of Waukee and approves setting July 26,2004 as the date to consider an 80120 Annexation
Petition.
