RESOLUTION 04-151 I
APPROVING PRE-ANNEXATION AGREEMENT WITH NANCY J.HINES,
WILLIAM J.HERMANN,JR.AND KATHLEEN MICHAEL
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee is proposing to annex certain real estate south and west
ofthe City's southern border;AND,
WHEREAS,property owned by Nancy J.Hines,William J.(Jim)Hermann and Kathleen
Michael is part ofthat proposed annexation;the legal description of which is:
A tract ofland in Govermnent Lot 9,in the Northeast Fractional
Quarter of Section 5,Township 78 North,Range 26 West of the 5th
Principle Meridian,Dallas County,Iowa;AND,
WHEREAS,William J.Lillis,attorney for Nancy J.Hines,William J.(Jim)Hermann
and Kathleen Michael after consultation with City Attorney Paul Huscher,Planning
Director Chad Weaver and City Administrator Mark Arentsen has submitted a Pre-
Annexation Agreement for this property;AND,
WHEREAS,further review by City staff and council members finds this pre-annexation
agreement acceptable.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 28th day of June 2004 that it hereby approves the Pre-Annexation Agreement
with Nancy J.Hines,William J.Hermann,Jr.and Kathleen Michael
