RESOLUTION 04-154 ]
APPROVING PAYMENT OF RETAINAGE FOR TK CONCRETE,INC.IN THE
AMOUNT OF $6,354.33
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,TK Concrete submitted the low bid for the Warrior Lane Sidewalk and Strom
Sewer Improvements;AND,
WHEREAS,Dales Sorensen of V &K,Inc.has reviewed the work and in his letter dated July 8,
2004 recommend that the 5%retainage be released in the amount of $6,354.33;AND,
WHEREAS,the State ofIowa Code,§573.13 and §573.l4 state that funds not exceeding 5%of
the contract price shall be withheld from payment and shall be retained for thirty days beyond the
date of final acceptance of the improvement;so that funds will be available for the payment of
claims for materials furnished and labor performed on the improvements;AND,
WHEREAS,the date of final acceptance of this project was June 7,2004.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
12th day of July 2004 that it hereby approves payment of retainage to TK Concrete,Inc.in the
amount of $6,354.33.
