RESOLUTION 04-170
APPROVING PRE-ANNEXATION AGREEMENT
WITH MARVIN AND IVA TERRY
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee is proposing to annex certain real estate south and west
ofthe City's southern border;AND,
WHEREAS,property owned by Marvin &Iva Terry and located at 3177 312th Street is
part of that proposed annexation;AND,
WHEREAS,M1'.and Mrs.Terry have signed a voluntary annexation petition and pre-
annexation agreement,which will be modified slightly to agree with the provisions in
Randolph Allison's petition and Michael Phillips'petition and re-signed;AND,
WHEREAS,further review by City staff and council members find this pre-annexation
agreement acceptable,AND,
WHEREAS,staff recommends acceptance of the three outstanding pre-annexation
agreements of which this pre-annexation agreement is one so as to complete the entire
annexation as a 100%voluntary annexation.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 19th day of July 2004 that it hereby approves the Pre-Annexation Agreement
with Marvin and Iva Terry.
