RESOLUTION 04-178
APPROVING PAYMENT OF RETAINAGE FOR VAN HAUEN &ASSOCIATES,INC.
FOR THE R-22 SANITARY SEWER IMPROVEMENTS,CONTRACT 1
IN THE AMOUNT OF $31,326.60
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Van Hauen &Associates,Inc.was awarded Contract #1 for the R-22 Sanitary
Sewer Improvements on June 2,2003 for a bid price of$637,302.00;AND,
WHEREAS,the Final Partial Payment Estimate (No.4)was approved for payment during the
June 21,2004 council meeting;AND,
WHEREAS,Dale Sorensen of V &K,Inc.has reviewed the work and approved the Final
Payment and indicated that payment of retain age could be paid 31 days after final acceptance;
AND,
WHEREAS,the State ofIowa Code,§573.l3 and §573.14 state that funds not exceeding 5%of
the contract price shall be withheld from payment and shall be retained for thirty days beyond the
date of final acceptance of the improvement;so that funds will be available for the payment of
claims for materials furnished and labor performed on the improvements;AND,
WHEREAS,the date of final acceptance of this project was June 28,2004.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
2nd day of August,2004 that it hereby approves payment of retainage to Van Hauen and
Associates,Inc.in the amount of $31,326.60.
