HomeMy WebLinkAbout2004-08-02-Resolutions 04-181_Sugar Creek Trunk Sewer - Development Agr - Hubbell RealtyTHE CITY OF WAUKEE,IOWA RESOLUTION 04-181 APPROVING DEVELOPMENT AGREEMENT WITH HUBBELL REALTY COMPANY WITH RESPECT TO CONSTRUCTION OF THE SUGAR CREEK TRUNK SEWER AND PUMPING STATION IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA WHEREAS,Hubbell Realty Co.(Hubbell)plans to purchase property containing approximately 290.22 acres;AND, WHEREAS,Hubbell and the City ofWaulcee have agreed that of this 290.22 acres, approximately 130 acres will be included in the University Avenue Sanitary Sewer Connection Fee District and will be subject to the University Avenue Connection fee;AND, WHEREAS,for the remaining 160.22 acres,Hubbell and the City of Waukee have agreed to a development agreement facilitating the construction of the Sugar Creelc Trunk Sewer and Pumping Station containing the following covenants,but not all of the covenants,summarily described: 1.The City agrees to construct Sugar Creek Trunlc Sewer and Pumping Station; 2.The City agrees to provide sanitary sewer facilities and service for 160.22 acres through the Sugar Creek Trunk Sewer and Pumping Station; 3.The City agrees that a payment of$294,000 by Hubbell Realty;that a perpetual easement provided by Hubbell for this Trunk Sewer;and that conveyance of property for the Pumping Station by warranty deed to the City shall represent the total financial contribution of Hubbell to the City ofWaulcee for this proj ect,which includes the City providing reserved sanitary sewer capacity sufficient to serve development ofI-Iubbell's Glynn Village. J NOW THEREFORE BE IT RESOL YED by the City ofWaulcee City Council in session this 2nd day of August 2004 that it hereby approves the Development Agreement with Hubbell Realty Company with respect to construction of the Sugar Creek Trunk Sewer and Pumping Station.
