THE CITY OF WAUKEE,IOWA
RESOLUTION 04-27
APPROVING THE FINAL PLAT FOR
WILLIAMS POINTE PLAT 3
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized
Municipal Organization;AND,
WHEREAS,the City of Waukee Planning and Zoning Commission approved the Final
Plat for Williams Pointe Plat 3 on December 23,2003;AND,
WHEREAS,the Williams Pointe Development,L.c.,in platting the property has
represented to the City of Waukee a cash bond for the installation of a recreation trail;the
improvement is to be completed in accordance with the Site Plan,Subdivision
Ordinances,Standard Specifications,and Platting Requirements of the Developer;AND,
WHEREAS,if Williams Pointe Development shall in all respects fulfill the said
obligation according to the terms thereof,and shall satisfy all claims and demands
incurred for same,and shall fully indemnify and save harmless the City of Waukee from
all costs and damages which it may suffer by reason of failure to do so and shall fully
reimburse and repay the City of Waukee all outlays and expenses which it may incur in
making good any such default,then this obligation is to be void and cash will be returned
to the developer;otherwise to remain in full force and effect;AND,
WHEREAS,the Final Plat for Williams Pointe Plat 3 is in general conformance with
section §303 -Land Subdivision Ordinance ofthe Waukee Municipal Code;and
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,
Iowa that the Final Plat for Williams Pointe Plat 3 be approved.
Passed by the City Council of the City of Waukee,Iowa,and approved the 2nd day of
February 2004.
