RESOLUTION 04-39
APPROVING PURCHASE OF 527 SQ.FT.OF LOT 3 OF HAWTHORNE RIDGE
TOWNHOMES,AN OFFICIAL PLAT,FROM MADONNA M.GARDINIER,
TRUSTEE OF MADONNA M.GARDINIER TRUST,IN THE AMOUNT OF
$1,581.00 PLUS $200 LEGAL COSTS OR $1,781.00 FOR THE PURPOSE OF
ACQUIRING LAND PRIOR TO WIDENING UNIVERSITY AVENUE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Lee Engineers &Surveyors have determined that certain real estate must be
obtained by the City of Waukee as part of and prior to the widening of University Avenue
AND,
WHEREAS,Lee Engineers &Surveyors have determined the real estate owned by
Madonna M.Gardinier,Trustee of Madonna M.Gardinier Trust in the full amount of 527
square feet is to be purchased by the City of Waukee for $1,581.00 plus $200 Abstract Title
work;AND,
WHEREAS,according to the agreement signed by Madonna M.Gardninier on the 25th of
February,2004,"final acceptance and approval of this agreement shall be executed by the
Waukee City Council within a period of 60 days from signature date of this agreement".
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session
this 1st day of March 2004 that it hereby approves the purchase of 527 square feet of Lot 3 of
Hawthorne Ridge Townhomes,an Official Plat,from Madonna M.Gardinier,Trustee of
Madonna M.Gardinier Trust in the amount of$I,581.00 plus $200 in legal costs or
$1,781.00 for the purpose of acquiring land prior to widening University Avenue.
