RESOLUTION 04-85 I
APPROVING SALE OF OLD LIBRARY BUILDING LOCATED
AT 500 6TH STREET CONTINGENT ON VENDEES
FAILURE TO PREVENT FORFEITURE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Mr.and Mrs.Terrones were the highest of three bids to purchase the library
building,which were received on the 7th of April,2003;AND,
WHEREAS,Mr.and Mrs.Terrones signed a purchase agreement and paid $500 in
earnest money on June 9th,2003;AND,
WHEREAS,the City Council approved the agreement with Mr.and Mrs.Terrones on
the 16th day of June 2003 with the expectation that Mr.and Mrs.Terrones would proceed
to purchase the old library;AND,
WHEREAS,ahnost a year later Mr.and Mrs.Terrones have not paid the remainder due
on the old library and have not communicated with the City Administrator or any other
City Staff;AND,1WHEREAS,Mr.and Mrs.Terrones were served with a Notice of Forfeiture of Real
Estate Contract for failure to pay balance of purchase price,which was $149,500.00 as of
Apri128,2004.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 3,-dday of May 2004 that it hereby approves the sale of the old library
building located at 500 6th Street contingent on the vendees,Michael and Paula Terrones,
failure to prevent forfeiture ofthis property.
