RESOLUTION 04-99
APPROVING AUTHORIZATION TO PROCEED WITH THE ACQUISITION OF
PRIVATE PROPERTY RIGHTS NEEDED FOR THE PROJECT AS AUTHORIZED BY
CHAPTER 6B.PROCEDURE UNDER EMINENT DOMAIN OF THE IOWA CODE.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City determines that if this proj ect is to be approved and constructed that is
will be necessary to obtain light of way from private property to do so,all as shown by the plans
prepared by Lee Engineers and Surveyors dated March 30,2004 for this project;AND,
WHEREAS,the City determines that for the general welfare of Waukee and in the best
interests of its citizens that the City consider the establislnnent of an amount which the City believes
to be just compensation for the acquisition of a parcel of right of way on University Avenue
Widening Project No.STP-U-8177(604)-70-25 in the City of Waukee,Iowa;AND,
WHEREAS,the right of way required for the project has all been acquired except for one
parcel owned by Gerald J.and Nancy L.Reese at 14625 University Avenue;AND,
WHEREAS,the Reese parcel has been appraised by Patrick J.Schulte,MAl,and Mr.
Schulte's April 26,2004,appraisal has been reviewed by James T.Hayes,Jr.,who has approved the
appraisal and recommended the City establish just compensation to be the full amount of the
reviewed and approved appraisal.
THEREFORE,BE IT RESOLVED that the City does hereby establish just compensation
for the Reese parcel to be the full amount of the reviewed and approved appraisal.
BE IT FURTHER RESOLVED that the City does hereby authorize Graham Land
Acquisition Associates,Inc.,to send the approved appraisal to Mr.and Mrs.Reese as required by
Section 6B.45 Mailing Copy of Appraisal of the Iowa Code ..
BE IT FURTHER RESOLVED that the City,through their representative,Graham Land
Acquisition Associates,Inc.,shall make a good faith effort to acquire said property through
negotiated purchase.
BE IT FURTHER RESOLVED that if the property cannot be acquired through negotiated
purchase that the City Council hereby authorizes the acquisition of the property by condenmation
procedures.
