RESOLUTION 04-123
APPROVING THE PRELIMINARY PLAT FOR
LEGACY POINTE PLAT 3
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City of Waukee Planning and Zoning Commission approved the Preliminary
Plat for Legacy Pointe Plat 3 on April 27,2004;AND,
WHEREAS,Developer agrees to include in the plat,as a Covenant and Condition running with
the laud,"The area designated as a surface water detention area will be mowed and maintained
by the Homeowner's Association as a Public Recreation Area kept accessible to the public and in
such manner as not to alter or impede the flow of surface water,and without altering the
elevations.Homeowner's Associate shall indemnify and hold the City of Waukee harmless from
any claims or demands arising out ofthe use ofthe area by the public";AND,
WHEREAS,the Preliminary Plat for Legacy Pointe Plat 3 is in general conformance with
section §303 -Land Subdivision Ordinance of the Waukee Municipal Code;and
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa
that the Preliminary Plat for Legacy Pointe Plat 3 be approved.
Passed by the City Council of the City of Waukee,Iowa,and approved the 7'h day of June 2004.
