RESOLUTION 05-47
APPROVING CITY STAFF TO PROCEED WITH PRELIMINARY STEPS TO
COMPLETE PUBLIC IMPROVEMENTS TO WARRIOR LANE FROM LAUREL TO
WINDFIELD PKWY IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 384
OF THE CODE OF IOWA
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee has requested of Jim Conlin,developer/owner of Wind field
Apartments,that his corporation re-construct the portion of Warrior Lane adjacent to his property
by widening and adding storm sewer,curb and gutter;AND,
WHEREAS,Attorney Bob Josten recommends the City proceed with the re-construction of that
portion of Warrior Lane in question and assess the benefits of the improvement to the two
apartment houses bordering Warrior Lane;AND,
WHEREAS,it is staffs recommendation that the City
1)proceed with the proj ect by designating an engineering firm,which will develop the
plans and specifications for the work and begin the assessment process;
2)give Mr.Conlin thirty (30)days from the point ofthe City's approval of a resolution to
proceed with the assessment process,to commit to constructing the portion of Warrior Lane
adj acent to his property;and
3)require that Mr.Conlin pay for the engineering services provided by the designated
engineering firm and any other expenses associated with the proj ect once the City begins the
assessment process and prior to Mr.Conlin's performance of the re-construction ofthe portion of
Warrior Lane adjacent to his property.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
28th day of March 2005 that it hereby approves the City proceed with the steps necessary to
complete the public improvements to Warrior Lane from Laurel to Windfield Pkwy in
accordance with the provisions of Chapter 384 of the Code of Iowa.
