RESOLUTION 05-68
APPROVING ACCEPTANCE OF CONLIN PROPERTIES OFFER
TO FUND STREET IMPROVEMENTS AND
AUTHORIZING ISSUANCE OF BUILDING PERMIT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee has requested Conlin Properties assume responsibilities for the
construction ofthat portion of Warrior Lane inunediately west of Wind field West Apartments;
AND,
WHEREAS,the City of Waukee has not granted a building permit for construction of the last
apartment building to be added to the Windfield West Complex;AND,
WHEREAS,Jim Conlin of Conlin Properties,through his attorney Mr.William J.Lillis,has
agreed,subject to construction and acceptance of a 3.5 feet wide section of street paving,curb
and gutter along Warrior Lane adjacent to the existing apartment complex,to reimburse the City
of Waukee the sum of $24,900.00 for said construction,AND,
WHEREAS,City Staff me in acceptance ofthis project and recommend it to you and also
recommend the Council grant the issuance of the building permit for the apartment building to be
added to the Windfield West Complex.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
18th day of April 2005 that it hereby approves and accepts the Conlin Properties offer to pay
$24,900.00 for Warrior Lane Improvements and authorizes issuance ofthe building permit.
