RESOLUTION 05-63A
APPROVING AGREEMENT WITH MIDAMERICAN ENERGY COMPANY,
WHICH STATES THE TERMS AND CONDITIONS TO BE MET BY THE CITY
OF WAUKEE PRIOR TO MIDAMERICAN ENERGY COMPANY GRANTING A
STORM SEWER EASEMENT TO THE CITY OF WAUKEE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,MidAmerican Energy acknowledges the City of Waukee's request that the
MidAmerican Energy Co.provide a storm sewer easement to the City;AND,
WHEREAS,MidAmerican Energy is willing to provide a storm sewer easement to the
City given the terms and conditions identified in the Letter Agreement are accepted by
the City of Waukee;AND,
WHEREAS,Paul Huscher,City Attorney,has reconnnended a language change,to
which MidAmerican Energy has agreed;AND,
WHEREAS,Public Works Director John Gibson has read the Agreement and
recommends approval of the changed Agreement.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 16 day of April 2005 that it hereby approves the Agreement with
MidAmerican Energy.
