RESOLUTION 05-22
APPROVING CONSENT TO ASSIGNMENT OF AND AMENDMENT TO THE J.
BRICK COMMERCIAL PARK,L.L.C.DEVELOPMENT AGREEMENT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City Council of Waukee,Iowa,approved Resolution 05-19 on the 24th
of January,2005 consenting to Assignment of and Amendment to J.Brick Commercial
Park,L.L.C.Development Agreement and Expressing Intent to Enter into Future
Development Agreement with Williams Pointe Development II,L.C.;AND,
WHEREAS,pursuant to Resolution 05-19 an agreement between tbe City of Waukee
and J.Brick Commercial Park,L.L.C.was prepared by the law firm of Dorsey &
Whitney and is hereto attached and made a part hereof;AND,
WHEREAS,John P.Danos,an attorney with Dorsey &Whitney,L.L.P.recommends
approving the attached agreement between the City of Waukee and J.Brick Commercial
Park,L.L.C.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 1st day of February 2005 that it hereby approves the attached agreement with
J.Brick Commercial Park,L.L.C.and directs staff to finalize this agreement with J.Brick
Commercial Park,L.L.C ..
