RESOLUTION 04-216
APPROVING THE CERTIFICATION OF REIMBURSABLE DEBT IN ACCORDANCE
WITH THE JOE BRICK DEVELOPMENT AGREEMENT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee and Mr.Joe Blick entered into a development agreement,Joe
Brick Development Agreement,on the 6th day of November,2000,which provided for the
reimbursement of expenses associated with the development ofthe property known as Brick
Business and Industrial Park;AND,
WHEREAS,reimbursable expenses for the development of the property are limited to:
construction of the internal improvements,and for any special assessments or connection fees
paid by the Company with respect to public sanitary sewer and water line improvements which
may be constmcted by the City."Qualified Expenses"shall include all actual construction costs,
engineering,legal fees and all related items,to the extent such expenses are documented to the
satisfaction of the City;AND,
WHEREAS,Joe Brick has submitted reimbursable expenses associated with the development of
Brick Commercial Park totaling $363,000.00,which have been reviewed and approved by city
staff.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
27'h day of September 2004 that it hereby approves the certification ofreimbursable debt in
accordance with the Joe Brick Commercial Park Development Agreement.
