APPROVING CITY STAFF REVIEW AND APPROVAL OF FUTURE PHASES OF
LEGACY POINTE TOWNHOMES
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City of Waukee Planning and Zoning Commission approved the City Staff
review and approval offutme phases of Legacy Pointe Townhomes on September 28,2004;
AND,
WHEREAS,Ewing Land Development of Pella,developers of the Legacy Pointe subdivision,
have as of this date acted in good faith with the City of Waukee;AND,
WHEREAS,the City staff of Waukee resolve to present to the Planning and Zoning
Commission and City Council any future phase plans of Legacy Pointe Townhomes which
deviate significantly from those approved prior to this date;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa
that City Staff review and approve future phases of Legacy Pointe Townhomes be approved.1
Passed by the City Council of the City of Waukee,Iowa,and approved the 27th day of
September 2004.
