RESOLUTION 04-236
APPROVING SOLICITATION OF OFFERS FOR CITY PROPERTY
LOCATED AT 500 6TH STREET IN WAUKEE PURSUANT TO SECTION 364.7 OF
THE IOWA CODE AND SETTING JANUARY 12,2005 AS THE DATE FOR RECEIPT
OF BIDS THEREFORE AND SETTING JANUARY 17,2005 AS THE DATE FOR
HEARING THEREON
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City Council at its May 3,2004 meeting by Resolution 04-85 supported the
forfeiture of real estate contract entered into with Michael and Paula Terrones during 2003;AND
WHEREAS,since that time the City has given the Waukee Area Arts Council 3 to 4 months to
secure funding for the purchase of the building to be used as a fine arts center;AND,
WHEREAS,the Waukee Area Arts Council has been unable to secure the funds necessary to
purchase the property;AND,
WHEREAS,the City of Waukee canuot give the building to the Waukee Area Arts Council
because it is not a governmental body and the building will not consistently be used for a public
purpose as is stated in Iowa Code Section 364.7(3);AND,
WHEREAS,the building decreases in value each month or year that it remains unoccupied,
unprotected from the elements;AND,
WHEREAS,City Staff recommend offering this property for sale with receipt of bids being
January 12,2005 and hearing &letting being January 17,2005.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
18th day of October 2004 that it hereby approves the solicitation of offers for city property
located at 500 6th Street in Waukee pursuant to Section 364.7 of the Iowa Code and sets January
12,2005 as the date for receipt of bids therefore and sets January 17,2005 as the date for hearing
thereon.
