THE CITY OF WAUKEE,IOWA
RESOLUTION 04-242
APPROVING THE FINAL PLAT FOR
LEGACY POINTE OF WAUKEE PLAT -3
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized
Municipal Organization;AND,
WHEREAS,Legacy Pointe Residential,L.L.C.has filed with the City Clerk of Waukee,
Iowa a Plat which is known as Legacy Pointe at Waukee -Plat 3,the same being a
subdivision of the following described real estate in Waukee,Dallas County,Iowa,to-wit:
Outlot E in Legacy Pointe at Waukee,Plat 2,an Official Plat,City of Waukee,
Dallas County,Iowa.Said Subdivision of Outlot E contains 27.72 acres.
WHEREAS,the City of Waukee Planning and Zoning Commission approved the Final
Plat for Legacy Pointe of Waukee Plat 3 on October 12,2004;AND,
WHEREAS,the Final Plat for Legacy Pointe of Waukee Plat 3 is in general conformance
with section §303 -Land Subdivision Ordinance ofthe Waukee Municipal Code;AND,
WHEREAS,after further review,several very minor items remain unfinished and
language permitting public access to Lot A has not been resolved;AND,
WHEREAS,staff have requested that approval of the Final Plat for Legacy Pointe be
granted contingent on completion of all unfinished items and contingent on the resolution
oflanguage permitting public access to Lot A.
NOW THEREFORE BE IT RESOLVED by the City Council ofthe City of Waukee,
Iowa that the Final Plat for Legacy Pointe of Waukee Plat 2 is approved contingent upon
completion of all unfinished items and contingent on the resolution oflanguage,which
once resolved will permit public access to Lot A.
Passed by the City Council of the City of Waukee,Iowa,and approved the 18th day of
October 2004.
