RESOLUTION 04-274
APPROVING PAYMENT OF RETAINAGE TO NATIONAL FIRE INSURANCE
COMPANY OF HARTFORD FOR THE 1-80 GAS MAIN INSTALLATION
PROJECT IN THE AMOUNT OF $19,527.75
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Murphy Bros.,Inc.was hired to perform the 1-80 Gas Main Installation and
upon default,National Fire Insurance Company of Hartford,the bonding company,paid
all bills related to the project;AND,
WHEREAS,the City of Waukee is directed by the Cook County Court to pay and turn
over the sum of $19,527.75 to NFIC,in satisfaction and extinguishment of all of its
payment obligation under its contract with Murphy for the Project;AND,
WHEREAS,Harris Trust &Savings Bank acknowledges that any claim it may have to
the contract funds to be paid under the Order from the City of Waukee to NFIC are not
subj ect to any continuing lien in law or equity which it may hold;AND,
WHEREAS,Count N is dismissed with prejudice.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 20th day of December 2004 that it hereby approves payment of the retainage
to National Fire Insurance Company of Hartford for the 1-80 Gas Main Project in the
amount of $19,527.75.
