HomeMy WebLinkAbout2004-12-20-Resolutions 04-272_Urban Renewal Area - Consolidate Legal DescriptionsRESOLUTION NO.04-272 )A resolution to consolidate the legal descriptions of three Urban Renewal Areas,pursuant to Section 403.4 of the Code of Iowa and approve urban renewal plan amendment WHEREAS,the City of Waukee (the "City")has previously created the Hickman West Urban Renewal Area,the Enterprise Business Park Urban Renewal Area and the Waukee Urban Renewal Area 2000 (the "Urban Renewal Areas");and WHEREAS,it has been proposed to amend the urban renewal plans for each of the Urban Renewal Areas in order to consolidate the legal descriptions of the Urban Renewal Areas;and WHEREAS,notice of a public hearing by the City Council of the City on the question of such consolidation and on a proposed amendment to the urban renewal plans for the Urban Renewal Areas was heretofore given in strict compliance with the provisions of Chapter 403 of the Code of Iowa,and the Council has conducted said hearing;and WHEREAS,the proposed urban renewal plan amendment was submitted to and approved by the Planning and Zoning Commission of the City; WHEREAS,copies of the urban renewal plan amendment,notice of public hearing and notice of a consultation meeting with respect to the urban renewal plan amendment were mailed to Dallas County,Waukee Community School District and the Des Moines Area Community College;the consultation meeting was held on the 2nd day of December,2004;and responses to any comments or recommendations received following the consultation meeting were made as required by law; I NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee, Iowa,as follows: Section 1.The amendment to the urban renewal plans for the Urban Renewal Areas attached hereto as Exhibit A and made a part hereof,is hereby in all respects approved, Section 2.It is hereby declared that the adoption of the amendment will have no effect on any of the tax increment ordinances which have been adopted for any of the City's urban renewal areas,01'on any of the base valuations which have been previously established for any of the City's urban renewal areas. .I Section 3.All resolutions OT parts thereof in conflict herewith are hereby repealed,to the extent of such conflict. The initial purpose of this Amendment to the urban renewal plans for the Enterprise Business Park Urban Renewal Area,the Hickman West Urban Renewal Area and the Waukee Urban Renewal Area 2000 (collectively the "Urban Renewal Areas")is to consolidate the legal descriptions of the Urban Renewal Areas,in order to maximize the benefits of future expenditures of incremental property tax revenues. Effective as of the date this Amendment is approved by resolution of the City Council of the City of Waukee,all real estate previously designated as being part of the Enterprise Business Park Urban Renewal Area will become part of the legal descriptions for the Hickman West Urban Renewal Area and the Waukee Urban Renewal Area 2000;all real estate previously designated as being part of the Hickman West Urban Renewal Area will become part of the legal descriptions for the Enterprise Business Park Urban Renewal Area and the Waukee Urban Renewal Area 2000;and all real estate previously designated as being part of the Waukee Urban Renewal Area 2000 will become part of the legal descriptions for the Enterprise Business Park Urban Renewal Area and the Hickman West Urban Renewal Area. 1 The adoption of this Amendment will have no effect on any ofthe tax increment ordinances which have been adopted for any of the Urban Renewal Areas,or on any of the base valuations which have been previously established for any of the Urban Renewal Areas.rexcept as specifically provided for herein.Additionally,this amendment will not nullify the respective urban renewal plans for the Hickman West Urban Renewal Area,the Enterprise Business Park Urban Renewal Area or the Waukee Urban Renewal Area 2000,and such plans shall remain in full force and effect. ) DORSEY &WHITNEY LLP,ATTORNEYS,DES MOINES,IOWA Waukee/419580-39/URPlan Amend Section 2.The second purpose ofthis amendment is to identify certain real property which will be acquired by the City in connection with an urban renewal project,as required by Section 403.17 of the Code of Iowa.The City will use tax increment fmancing to purchase the real property legally described as follows: A tract of land located in an irregular shaped parcel of land being a part of the East Half (E 112)of the Southeast QU31ier (SE 1/4)of Section 34,Township 79 North,Range 26 West of the 5th P.M.as recorded in Book 840 on page 694 in the Dallas County Recorder's Office,Iowa. Said Tract being more particularly described as follows: Connnencing as a point of reference at the Southeast Comer of said Section 34;thence North 00°21 '43"East (all bearings referenced to Grid North Iowa State Plane Coordinate System South Zone),a distance of 528.57 feet along the east line of said E 1/2 ofthe SE 1/4;thence North 89°38'17"West,a distance of50.00 feet to the west right-of-way line of Alice's Road, said point being the point of beginning;thence South 00°21 '43"West,recorded as (S00004'00" E),a distance of 416.30 feet along said west right-of-way;thence South 45°14'20"West,a distance of74.39 feet (recorded as S 45°12'21"W.74.35 feet)to the north right-of-way line of University Avenue;thence North 89°53'04"West (recorded as S 89°41 '53"W),a distance of 131.05 feet along said north right-of-way line to the north line of Union Pacific Railroad right- of-way;thence North 62°48 '28"West (recorded as N 63°13 '31"W),a distance of 43.17 feet along said railroad right-of-way;thence South 89°49'52"East,a distance of 61.31 feet to a point of curvature;thence northeasterly a distance of 36.65 feet along a curve concave to the northwest having a central angle of70000'00",a radius of30.00 feet,a chord bearing of North 55°10'08" East and a chord distance of34.4l feet;thence North 20°10'08"East,a distance of96.62 feet; thence North 27°00'42"East,a distance of 83.93 feet;thence North 20°10'08"East,a distance of 92.37 feet to a point of curvature;thence northeasterly a distance of 180.80 feet along a curve concave to the northwest having a central angle of 19°48'25",a radius of 523.00 feet,a chord bearing of North 10°15'56"East,and a chord distance o£179.90 feet to the point of beginning.
