RESOLUTION 04-262
APPROVING PAYMENT OF RETAINAGE FOR REILLY CONSTRUCTION CO.,INC.
IN THE AMOUNT OF $4,582.45
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Reilly Construction Co.,hIC.submitted the low bid for the Wanior Park Grading
Improvements and was awarded the contract on July 12,2004;AND,
WHEREAS,the Final Payment Estimate in the amount of$87,066.50 was approved for
payment during the September 13,2004 council meeting;AND,
WHEREAS,City Engineering Technician Brad Freeman reviewed the work of Reilly
Construction Co.,Inc.and his letter recommended approving the Certificate of Completion at the
City Council meeting,September 13,2004;AND,
WHEREAS,the State ofIowa Code,§573.13 and §573.14 state that funds not exceeding 5%of
the contract price shall be withheld from payment and shall be retained for thirty days beyond the
date of final acceptance of the improvement;so that funds will be available for the payment of
claims for materials furnished and labor performed on the improvements;AND,
WHEREAS,proof of satisfaction of all taxes and all liens,if any,to be submitted by Reilly
Construction Co.,Inc.was received by City staff Friday,October 29,2004.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
20th day of December 2004 that it hereby approves payment of retain age to Reilly Construction
Co.,Inc,in the amount of$4,582.45.
