RESOLUTION 08-45
APPROVING THE FINAL PLAT FOR
SHOTTENKIRI(WAUKEEPLATI
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Shottenkirk Partnership,L.P.(the "Developer")has requested final approval of
Shottenkirk Waukee Plat 1 (the "Plat");AND
WHEREAS,the City of Waukee Planning and Zoning Commission approved the Final Plat for
Shottenkirk Waukee Plat 1 on November 13,2007;AND,
WHEREAS,the Developer has entered into a Development Agreement with the City regarding
public improvements associated with N.6th Street located adjacent to the Plat;AND,
WHEREAS,the Final Plat for Shottenkirk Waukee Plat 1 is in general conformance with
section §303 -Land Subdivision Ordinance of the Waukee Municipal Code;
NOW THEREFORE BE IT RESOLVED by the City Council ofthe City of Waukee,Iowa on
this 2Sth day of February 2008 that the Final Plat for Shottenkirk Waukee Plat 1 be and the same
is hereby accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following
additional easements to be filed with the Plat subj ect to final review and approval by the City
Attorney:
1.Easement for Private Surface Water Flowage and Detention;
2.Easement for Private Storm Sewer;
3.Easement for Sanitary Sewer;
4.Easement for Water Main and Public Utility;
S.Easement for Public Utility;
6.Easement for Public Purpose;
7.Easement for Public Ingress/Egress;
8.Easement for Water Main and Gas.
BE IT FURTHER RESOLVED that the City of Waukee does hereby grant a temporary trail
easement associated with the trail to be constructed within the N.6th Street right of way to
provide a temporal)'connection to the Raccoon River Valley Trail System.
BE IT FURTHER RESOLVED that the sidewalks within the Plat are not now constructed,
provided,however,that in no event shall a certificate of occupancy be issued on a lot within the
Plat until all sidewalks on such lot that are required by the Plat are constructed.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the Warranty
Deed for Street Lot A and a portion of Parcel C east of the N.6th Street right of way.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to file the
fmal plat of Shottenkirk Waukee Plat I,as well as any other documents related thereto,with the
Dallas County Recorder.
