RESOLUTION 08-56
RESOLUTION APPROVING THE AMENDMENT TO EMPLOYMENT CONTRACT
AND AGREEMENT WITH THE CITY ADMINISTRATOR.
IN THE NA1vIE AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City entered in to an Employment Contract and Agreement on or about April
21,2006 with the City Administrator;AND,
WHEREAS,the City and Jeffrey L Kooistra desire to move the evaluation time frames to a time
in closer proximity to the fiscal year and typical staff evaluations and make the necessary
amendments to the existing contract to effectuate the same.
BE IT THEREFORE RESOLVED by the City of Waukee City Council on this,the 10th day of
--March 200£,that-the-Amendment to-Employment Contract-and Agreement attached her·eta as ---
Exhibit "A"is hereby approved and the Mayor is authorized to execute the same on behalf of the
City.

AMENDMENT TO EMPLOYMENT CONTRACT AND AGREEMENT
THIS AMENDMENT TO EMPLOYMENT CONTRACT AND AGREEMENT made
and entered into this 10th day of March,2008,by and between the City of Waukee,Dallas
County,Iowa,by its Council Members (hereinafter referred to as "Employer")and Jeff Kooistra,
an individual and resident of the State of Iowa (hereinafter referred to as "Employee")both of
whom understand as follows:
WHEREAS,an EMPLOYMENT CONTRACT AND AGREEMENT was entered into
between the Jeffrey L.Kooistra and the City of Waukee on or about the 21st day of August,
2006;and
WHEREAS,the parties are desirous of continuing the at will employment relationship
under the terms specified in said Employment Contract and Agreement but seek to amend
paragraph 10 of the agreement in order to provide for the annual evaluation of Employee in
closer proximity to the commencement of the budget year and at or about the time other staff are
having evaluations commencing in 2009;and
The parties to the Employment Contract and Agreement approved by the City on August 21,
2006,in consideration of the continuation of the at will employment relationship by both parties,
and other valuable consideration,the receipt and sufficiency of which is acknowledged by both
parties,agree to amend said agreement by deleting paragraph 10 thereof and replacing said
paragraph with the following:
10)Performance Evaluation
A.The Council,or their designee,shall review and evaluate the performance
of the Employee,in writing,on or before June 30'2009 and annually thereafter.
Said review and evaluation shall be in accordance with specific criteria developed
jointly by the Employer and the Employee.Said criteria may be added to or
deleted from,as the Council may,from time to time,determine in consultation
with the Employee.
B.Annually,tile Council and the Employee shall define such goals and
performance objectives that they determine necessary for the proper operation of
the City.
C.In effectuating tile provisions of this Section,the Council and the
Employee mutually agree to abide by the provisions of applicable law.
