RESOLUTION 08-73
APPROVING AMENDMENTS TO EASEMENTS AtID DECLARATION FOR
WAUKEE VISTA COMMERCIAL PARK
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Waukee Properties Partnership is owner of Lots 2,3,4 and 5 of Waukee Vista
Commercial Park,and Melvin Charles Revocable Living Trust UDA and Mary Ann Gillenwater
Revocable Living Trust UDA are owners of Lot I of Waukee Vista Commercial Park (Property
Owners);AND,
WHEREAS,the Property Owners granted a Water Main and Line Easement(s)(Easement)to
the City of Waukee which was accepted by the City of Waukee and recorded with Dallas
County,Iowa on December 5,2006,in Book 2006,Page 19691;AND,
WHEREAS,the Property Owners also granted a Declaration of Easement,Covenants,and
Conditions (Declaration)to the City of Waukee which was accepted by the City of Waukee and
recorded with Dallas County,Iowa on December 5,2006,in Book 2006,Page 19689;AND,
WHEREAS,the recorded Easement and Declaration for Waukee Vista Commercial Par-k must
be amended to reflect improvements as constructed related to the location of a water main and
the frontage road;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa on
this 7th day of April 2008 that the amendments to the Water Main and Line Easement(s)and
Declaration of Easement,Covenants,and Conditions gr-anted to the City ofWaulcee in
connection with the Property is hereby approved and accepted by the City of Waukee,and the
City Clerk is hereby authorized to file such amendments with the Dallas County,Iowa Recorder.
