RESOLUTION 08-100
APPROVING THE FINAL PLAT FOR
THE CROSSING AT ALICE'S ROAD PLAT 1
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Alices,L.C.and Hy-Vee,Inc.(the "Developers")have requested final approval of
The Crossing at Alice's Road Plat I (the "Plat");AND
WHEREAS,the City of Waukee Planning and Zoning Commission approved the Final Plat for
The Crossing at Alice's Road Plat I on September 25,2007;AND,
WHEREAS,the Developers have entered into a Development Agreement with the City
regarding public improvements associated with NE Alice's Road located adjacent to the Plat;
AND,
WHEREAS,the Final Plat for The Crossing at Alice's Road is in general conformance with
section §303 -Land Subdivision Ordinance of the Waukee Municipal Code;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa on
this s"day of May 2008 that the Final Plat for The Crossing at Alice's Road Plat I be and the
same is hereby accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following
additional easements to be filed with the Plat subject to final review and approval by the City
Attorney:
1.Easement for Public Utility.
BE IT FURTHER RESOLVED that the sidewalks within the Plat are not now constructed,
provided,however,that in no event shall a certificate of occupancy be issued on a lot within the
Plat until all sidewalks on such lot that are required by the Plat are constructed.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the Warranty
Deed for Street Lot A and B.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to file the
final plat of The Crossing at Alice's Road Plat I,as well as any other documents related thereto,
with the Dallas County Recorder.
