RESOLUTION 08-129
28E AGREEMENT FOR OPERATION AND MAINTENANCE OF THE
METROPOLITAN SALT STORAGE FACILITY BY AND BETWEEN THE CITIES
OF DES MOINES,WEST DES MOINES,URBANDALE,JOHNSTON,CLIVE,
WINDSOR HEIGHTS,WAUKEE,GRIMES AND PLEASANT HILL
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE,IOWA
WHEREAS,the Cities,commensurate with this Agreement,are entering into a 28E Agreement
for the Lease Purchase of a Metropolitan Salt Storage Facility (hereinafter referred to as the
"MWA Agreement")on property owned by the Metropolitan Waste Authority (MWA);and
WHEREAS,pursuant to that MW A Agreement,the MW A is agreeing to construct a
Metropolitan Salt Storage Facility on MW A property pursuant to the terms of the MW A
Agreement but said Agreement does not provide for how the Facility will be operated and
maintained by the Cities;and
WHEREAS,the Cities desire to enter into this Agreement to provide for the Operation and
Maintenance of the Facility.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
16th day of June,2008 that it hereby approves 28E Agreement for Operation and Maintenance of
the Metropolitan Salt Storage Facility By and Between the Cities of Des Moines,West Des
Moines,Urbandale,Johnston,Clive,Windsor Heights,Waukee,Grimes and Pleasant Hill.
Passed by the City Council of the City of Waukee,Iowa,and approved this the 16th day of June,
2008.
