RESOLUTION 09-178
APPROVING AND ACCEPTING PERPETUAL RECREATION TRAIL EASEMENT(S)
FROM LEGACY POINTE RESIDENTIAL,LLC,IN THE AMOUNT OF $1.00
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,it has been determined that a perpetual recreation trail easement is necessary for
the purpose of construction of a portion of recreation trail that will link trails between the Cities
of Waukee and Clive;AND,
WHEREAS,said easement shall be located on a portion of the property owned by Legacy
Pointe Residential,LLC,legally described as follows:
Lot A,Legacy Pointe at Waukee Plat 3,an Official Plat,now included in and forming a
part of the City of Waukee,Dallas County,Iowa.Said perpetual easement being more
particularly described as follows:the East 30.00 feet of said Lot A,containing 21,600
square feet,more or less.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
14th day of September 2009 that it hereby approves the Perpetual Storm Sewer Easement(s)from
Legacy Pointe Residential,LLC,with payment made by the City to the property owner(s)s in the
amount of$1.00.
