RESOLUTION 09-179
APPROVING AND ACCEPTING PERPETUAL RECREATION TRAIL EASEMENT(S)
FROM WALNUT CREEK LITTLE LEAGUE IN THE AMOUNT OF $1.00
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,it has been determined that a perpetual recreation trail easement is necessary for
the purpose of construction of a portion of recreation trail that will link trails between the Cities
of Waukee and Clive;AND,
WHEREAS,said easement shall be located on a portion of the property owned by Walnut Creek
Little League,legally described as follows:
Lot 3,Country Club West Plat 1,an Official Plat,now included in and forming a part of
the City of Waukee,Dallas County,Iowa.Said perpetual easement being more
particularly described as follows:beginning at the Northwest corner of said Lot 3;thence
North 89°33 '38"East,50.00 feet along the North line of said Lot 3;thence South
45°25'21"West,70.69 feet to the West line of said Lot 3;thence North 00°24'19"East,
50.00 feet along said West line to the point of beginning,containing 1,250 square feet,
more or less.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
14'1.day of September 2009 that it hereby approves the Perpetual Storm Sewer Easement(s)from
Walnut Creek Little League,with payment made by the City to the property owner(s)s in the
amount of$1.00.
