RESOLUTION 09-203
APPROVING AND ACCEPTING STORM SEWER EASEMENT(S)FROM A
PROPERTY OWNER WITHIN THE NORTHVIEW DRIVE EXTENSION AND 6TH
STREET IMPROVEMENTS PROJECT IN THE AMOUNT OF $1.00
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,it has been determined that a storm sewer easement is necessary for the purpose of
construction of the Northview Drive Extension and 6th Street Improvements Project;AND,
WHEREAS,said easement shall be located on a portion of the property owned by Waukee
Community School District,legally described as follows:
Parcel "B"in part of the Northwest Quarter of the Southwest Quarter (NW v"SW v,,)and
part ofthe Northeast Quarter of the Southwest Quarter (NE v"SW v,,)all in Section 33,
Township 79 North,Range 26 West of the SthP.M.,Dallas County,Iowa.Said perpetual
easement being a strip easement 30.00 feet in width lying IS.OO feet on each side of the
following described line or line extended:Commencing as a point of reference at the
Southeast corner of said Parcel "B";thence North 00°(degrees)09'(minutes)]3"
(seconds)West (all bearings referenced to Grid North Iowa State Plane Coordinate
System South Zone),a distance of 776.99 feet along the East line of said Parcel "B"to
the point of beginning;thence North 90°00'00"West,a distance of243.89 feet;thence
North 00°00'00"East,a distance of IS8.94 feet to the North line of said Parcel "B,"
containing 12.080 square feet,more or less.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
Sth day of October 2009 that it hereby approves the Storm Sewer Easement(s)from Waukee
Community School District,property owner within the Northview Drive Extension and 6th Street
Improvements Project,with payment made by the City to the property owners in the amount of
$1.00.
